FCC Grants Thriteen Appeals

The FCC has granted 13 appeals of decisions made by USAC denying E-rate applicants funding on the grounds that their funding requests were canceled unintentionally or erroneously.  The affected applications were remanded to USAC for further consideration with instructions for USAC to complete their review and issue funding commitment decisions on these E-rate requests within 90 days.

Of the 13 petitioners, nine indicated that they sought cancellations in error, two argued that they never sought cancellations, and two others said that staffing problems caused the cancellations.   Based on their review, the FCC found that the applicants did not intend to cancel their funding requests.

The FCC categorized the issues at hand as "minor mistakes" on the part of the applicants, and cited the Bishop Perry Order to show that the rejection of these funding requests was not warranted.
