FCC Releases July E-rate Appeal Decisions

On July 30, 2015, the FCC released several appeal decisions related to the E-rate program. The FCC granted 21 appeals and waivers, while denying 36 appeals.

Successful appeals and waiver requests dealt with the following issues:

  • Invoice Deadline Extension Requests Less Than 12 Months Late
  • Late Filed FCC Form 471 Applications – Filed Within 14 Days of the Close of the Window
  • Late Filed FCC form 471 Applications – Circumstances  Beyond Applicant’s Control

Appeals were denied regarding the following issues:

  • Failure to consider price as the primary factor in vendor selection process
  • Ineligible Entities
  • Invoice Deadline Extension Requests Less Than 12 Months Late
  • Invoice Deadline Extension Requests More Than 12 Months Late
  • Late Filed FCC Form 471 Application
  • Ministerial and/or Clerical Errors
  • Untimely Filed Request for Review
