FCC to Release E-rate Order and NPRM as 471 Window Closes

The FCC has posted a tentative agenda for an Open Meeting to be held on February 11, 2010. The agenda reveals the FCC’s plan to release an Order and Notice of Proposed Rulemaking which addresses allowing schools to open up E-rate-discounted Internet access to the public during non-operating hours.

Such a move would be a departure from past regulations where schools have been required to calculate public usage to ensure that E-rate funding is not subsidizing that portion of the service. 

The FCC notes in the tentative meeting agenda that this potential change would not affect the Form 471 applications for Funding Year 2010 which are due on February 11th.
