Court Pauses Bus Wi-Fi Case for FCC Review

The Fifth Circuit has paused the Bus Wi-Fi case, Molak v. FCC, to give the Commission time for an internal review of its prior decision. This move follows changes in FCC leadership and aims to reassess how Wi-Fi on school buses qualifies under the E-rate program.

Petitioners Maurine and Matthew Molak and the FCC jointly requested the Fifth Circuit to pause the Bus Wi-Fi case, citing changes in FCC leadership and plans to review its prior ruling (FCC 23-84) on E-rate eligibility for school bus Wi-Fi. The court granted the motion on July 10, 2025, requiring FCC status updates every 90 days while the agency reconsiders its decision.
