FCC Releases Appeal Decisions

On April 29, 2015 the FCC released several appeal decisions related to the E-rate program. The FCC granted 23 appeals and waivers while denying 7 stakeholder appeals. 

The successful appeals and waiver requests had to do with the following issues:

  • Cost Effectiveness Review
  • Early installation
  • Eligible services
  • Late filed form 471 Item 21 Attachments
  • Late filed Form 471 Applications
  • Ministerial or clerical errors
  • Service substitutions
  • Signed contract requirements
  • Service implementation deadline extension requests filed late
  • Violation of competitive bidding 28 day bidding rule

The appeals denied had to do with the following issues:

  • Service implementation deadline extension requests filed late
  • Untimely filed appeals request for review
  • Violation of competitive bidding 28 day bidding rule
