Limited Invoicing Appeals Granted

On May 30, 2017, the FCC released an Order granting two Petitions for Reconsideration. The FCC granted the Jefferson-Madison Regional Library petition that reversed a USAC decision to rejecting their appeal tied to the BEAR process. Jefferson-Madison Regional Library filed a timely BEAR form, but their service provider did not certify the form by the deadline and USAC and the FCC both had originally denied this appeal. Under the Petition for Reconsideration, the FCC now agrees that not only should Jefferson Regional Library receive reimbursement, but granted 37 other requests tied to the same issue. The FCC also has directed USAC that similarly-situated applicants, not limited to the ones in this specific appeal, to resubmit invoice filings.
 
The FCC also granted a Reconsideration Petition to White Lake School District. The FCC can grant waivers of their rules when it serves the public interest. White Lake School District has limited staff and the person handling the invoicing found out they had a brain tumor just weeks before the invoicing deadline which the FCC in this appeal decision stated, “…made it impossible to timely file its BEAR forms or know to seek an extension of the filing deadline….”
