Some Early Form 470 Filers May Need to Resubmit

The SLD announced this week that any applicant who filed a Form 470 this Spring seeking tariffed or month-to-month services in either the telecommunications or internet access categories will need to resubmit the form using the new FY 2011 Form 470, which was made public on July 1. Failure to resubmit the form will result in a denial for any Form 471 tied to that procurement. Applicants that posted a Form 470 this Spring with the FY 2010 Form 470 and sought a contract or signed an agreement, do not need to resubmit their Form 470 and repeat the 28 day competitive bidding process.

According to a Funds For Learning analysis, there were 67 Forms 470 filed between March 1, 2010 and June 30, 2010 where an applicant was specifically looking for either telecommunications or internet access services that may be affected by this new SLD administrative procedure. The SLD indicated they would conduct outreach to any affected applicant. However, if you are on this list you should consider reaching out to the SLD and confirming whether or not if you are required to repeat your procurement and resubmit a new Form 470.
