March Appeal Decisions Released

On March 30, 2017 the Federal Communications Commission (FCC) released several appeal decisions related to the requests for review, requests for waiver, and petitions for reconsideration of E-rate beneficiaries. The FCC dismissed 15 requests, granted 2 and denied 51 appeals on various grounds.
Successful Appeals were tied to:
  • FCC Form 486 – Late Filed
  • Ministerial and/or Clerical Error — Invoicing
Appeals involving issues listed below were denied:
  • Failure to Consider Price of Eligible Services as Primary Factor in Vendor Selection
  • Improper Service Provider Involvement
  • Invoice Deadline Extension Requests
  • Late-Filed FCC Form 471 Applications
  • Untimely Filed Requests for Review
USAC has 90 days from this Public Notice to complete their review of the two successful appeals. The streamlined appeal decisions can be viewed here.
