FCC Releases June Appeal Decisions

On June 29, 2018, the Federal Communications Commission (FCC) released several appeal decisions related to the requests for review, requests for waiver, and petitions for reconsideration of E-rate beneficiaries. The FCC dismissed 4 requests, granted 9 and denied 33 appeals on various grounds. 
 
Successful appeals tied were tied to:
  • Late-Filed FCC Form 471 Applications Filed within 14 Days of the Close of the Window
  • Late-Filed FCC Form 471 Applications – Due to Actions Beyond Its Control
  • Ministerial and/or Clerical Errors
  • Waiver of Appeal- or Waiver-Filing Deadline
Denials were issued for appeals involving the following issues:
  • Late-Filed FCC Form 471 Applications
  • Seeking E-rate Support for Services Not Covered by the Applicant’s Competitive Bidding Process
  • Untimely-Filed Appeals or Waiver Requests
The Order directs USAC to issue a funding commitment within 90 calendar days from the release of this notice. The FCC appeal decisions can be viewed here.
