ECF Applicants Subject to Audits

In its November 2023 Emergency Connectivity Fund newsletter, USAC noted that the Federal Communications Commission has updated their Frequently Asked Questions site to address questions related to the federal Single Audit Act. Through the FAQs, the FCC clarifies that applicants expending $750,000 or more in ECF funds are subject to the Single Audit Act, requiring the preparation of a Schedule of Expenditures of Federal Awards (SEFA) and other obligations.

The FCC indicates that applicants may receive inquiries from USAC regarding potential audit findings stemming from Single Audit Act reviews, and provides guidance regarding audit findings:

Depending on the scope and severity of any audit finding(s), there is a wide range of potential corrective actions that auditees may face. Corrective actions could be limited to implementation of a corrective action plan, may include an opportunity to cure any deficiencies, or could result in a financial recovery, if required, that is commiserate with the scope of the violation(s). Auditees will have an opportunity to appeal any adverse decision pursuant to 47 CFR § 54.1718 of the Commission’s rules.
